Emerging designers terms and conditions

  1. Eligibility: This Promotion is only open to residents of the UK, Republic of Ireland, Channel Islands and Isle of Man aged 18 or over only, excluding employees or agents of the Promoter or anyone professionally connected to this Promotion.
  2. No purchase is necessary to enter, however internet access is required.
  3. To Enter: Design a unique fabric print design suitable for use on any sofa.com product. Then upload it at www.sofa.com/emerging-designers. Your submission must include:
    1. Photos of at least one and up to five ‘mood boards’ which describe the key influences that took you from the original idea to the final design and how you got there. This may include fabric samples, additional photography, written explanation etc.
    2. A representation of one our products made using your fabric design. You must use one of the six available renders, downloadable from www.sofa.com/emerging-designers.
    3. A photograph of you, the entrant – a headshot which must be clear and unblurry.
    4. The name for your new fabric design.

All entries must be submitted in JPEG format, maximum file size 5MB per image.

  1. Entries must be received by 11.59pm on 31st December 2012.
  2. Only one submission per person.
  3. Entries will be rejected by the Promoter if the Promoter feels the entries are inappropriate, including but not limited to the following reasons:
    1. contain defamatory, malicious, indecent or other inappropriate content;
    2. the fabric design has been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means not relating to this promotion;
    3. the fabric design refers to brands other than those of the Promoter;
    4. the fabric design includes trademarks, logos or copyrighted material not owned by you or permitted under the license agreement of this competition
    5. the fabric design includes the names, images, video footage or similar of any individual without their express permission;
    6. represent a danger to health and safety;
    7. disparage the promoter or any other person or party affiliated with the promotion;
  4. Entries will then be moderated and if they pass, shortlisted and posted on a dedicated page on the sofa.com website.
  5. The shortlist will be put to a panel of judges containing at least one independent judge, who will judge each entry.
  6. Entries will be judged on the following criteria:
    1. originality of design
    2. creativity
    3. suitability to sofa upholstery
    4. best use of inspiration
  7. The entries with the highest scores as judged by the panel will be awarded the following prizes:
  8. The Prizes:
    1. TOP Prize: One winner will win:
      1. a £3,000 cash prize;
      2. the winning fabric design to go into production as a sofa.com exclusive designer material;
      3. professional lifestyle photography of their winning fabric upholstered on sofa.com product(s), worth over £5,000;
      4. the chance to boost your profile through on- and off-line PR and media work using our specialist PR agency
    2. Runners Up: 2 winners will win £1,000 plus the chance to boost your profile through on- and off-line PR and media work using our specialist PR agency
  9. The People’s Vote: Shortlisted entrants will be encouraged to obtain votes from friends and peers to vote for their entry at www.sofa.com/emerging-designers between 00:01 14 January 2013 2013 and 23:59 on 14 February 2013. These votes have no impact on the overall decision of the judges, but those placing a vote will be entered into a prize draw to win one of 50 Sofa.com ‘comfy kits’ including hand-made sheepskin-lined slippers, chocolate and cherry brandy. The shortlisted entrant receiving the highest number of votes will win £1000 to spend at sofa.com. Only one vote may be submitted per person for each entry.
  10. All winners, including those who have submitted a vote will be notified by 8 February 2012.
  11. In the event that a winner is unreachable, ineligible, or fails to claim the prize within 7 days of notification, the winner shall forfeit their prize and the prize may be awarded to the next placed entrant.
  12. There is no cash or other prize alternative available unless otherwise stated. Prizes are non-transferable and may not be substituted by the winner. No compensation will be payable if the winner is unable to use the prize as stated.
  13. No responsibility is accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind.
  14. By entering this Promotion you (the “participant”) agree to be bound by these terms and conditions.
  15. Rights in entries submitted to the Promoter by winners: winners hereby grant the Promoter and its agents a royalty-free exclusive license in perpetuity throughout the world, to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, grant sublicenses, adapt, publish, exploit, and use the entry in any and all media, in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation. The promoter reserves the right to use any winning entry throughout the world for any of its commercial or marketing purposes in all and any media, including, without limitation, in printed publications, presentations, promotional materials, in the advertising of Sofa.com’s goods or services on television or on Sofa.com’s website (the “Purpose”) in its original format or edited or altered in any way which HTC deems appropriate.
  16. The Promoter reserves the right at its absolute discretion to disqualify Entries which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this Promotion.
  17. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.
  18. Entries or votes must be made by the participant or voter, and must not be made through agents or third parties. Entries or votes made online using methods such as a macro, a script or the use of automated devices or processes are not allowed and all such entries or votes will be disqualified. Proof of identity may be requested.
  19. No bulk, third party or organised group entries will be accepted.
  20. The Promoter’s decision is final and no correspondence will be entered into.
  21. Winner’s names and winning entries will be available after 28 February 2013 by sending a SAE to : Emerging Designers Competition c/o Marketing at sofa.com, Unit 40 Chelsea Wharf, 15 Lots Road, London, SW10 0QJ
  22. The Promoter reserves the right to publish the name and county of residence of the winners.
  23. The winners may be required to participate in the Promoter’s marketing and promotional activities and by entering the Promotion consents to such participation.
  24. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this prize draw or communicating with entrants. The participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy.
  25. The Promoter shall not be liable for any interruption to this Promotion whether due to force majeure or other factors beyond the Promoter’s control.
  26. By entering the Promotion, the participant agrees to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession, attendance at or use of any prize (except death or personal injury caused by the Promoter’s negligence, for fraud, or otherwise as prohibited by law).
  27. Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction.
